1. File your claim and get the Defence

First, you must file your claim and proof that you served the claim on your employer with the Small Claims Court.

Once you the claim, your employer has 20 days to you with what's called a Form 9A: Defence. They also have to file this with the court. On the Defence form, the employer explains why they disagree with all or part of your claim.

There are rules your employer must follow when they serve you with the Defence. They also have to file the Defence with the court.
